## Short-term rental and Airbnb management in Clearwater

The City of Clearwater covers both the mainland and Clearwater Beach, and the two behave very differently for owners. On the beach, the Tourist District is where nightly stays belong. On the mainland, any home in a residential zone must be rented for at least 31 days or one calendar month.

So property management in Clearwater off the beach usually means monthly furnished rentals and annual leases. Owners still need the same things a nightly host needs: good photos, careful screening, reliable cleaning between tenants and someone who answers the phone. Our short-term rental management team applies that same system to 31-day-plus stays.

## Where guests come from

- **Morton Plant Hospital.** BayCare’s [Morton Plant Hospital](https://baycare.org/locations/hospitals/morton-plant-hospital/patients-and-visitors) is at 300 Pinellas Street. Clinicians on temporary assignments and patient families look for furnished housing nearby.
- **Spring training.** [BayCare Ballpark](https://www.mlb.com/phillies/spring-training/ballpark) opened in 2004 and is the Phillies’ spring training home and the home of the Low-A Clearwater Threshers. The Phillies have trained in Clearwater since 1947.
- **Downtown waterfront.** The city’s [Coachman Park](https://www.myclearwater.com/) hosts concerts at The BayCare Sound and the Clearwater Jazz Holiday, and the city lists several downtown redevelopment projects underway.
- **Island Estates and the marina.** The city operates the Island Estates public boat slips and is replacing the Clearwater Beach Marina, both listed on [myclearwater.com](https://www.myclearwater.com/).
- **Air access.** [St. Pete-Clearwater International Airport](https://www.fly2pie.com/) is the closest commercial airport.

## Clearwater short-term rental rules

Clearwater’s evidence rule in §3-919 dates from 2003, before Florida’s June 1, 2011 cutoff for local duration limits in [§509.032(7)(b)](https://www.leg.state.fl.us/Statutes/index.cfm?App_mode=Display_Statute&URL=0500-0599%2F0509%2FSections%2F0509.032.html). The definition of residential use in [§8-102](https://library.municode.com/fl/clearwater/codes/community_development_code?nodeId=PTICODECO_ART8DERUCO_S8-102DE) leaves out rentals shorter than 31 days or one calendar month on residentially zoned property, and it also leaves out timeshares and fractional ownership.

[Section 3-919](https://library.municode.com/fl/clearwater/codes/community_development_code?nodeId=PTICODECO_ART3DEST_DIV9GEAPST_S3-919PRFAEVCEUSREZODI) gives code enforcement its evidence list. Holding a state transient license, advertising as a vacation rental, taking overlapping bookings under 31 days, or using a booking agent can all be used to show a prohibited short rental. In practice, that means a residential-zone listing must say “31-night minimum” and mean it.

Homes outside residential zoning follow their own district rules, and a nightly rental anywhere needs a DBPR license under [§509.241](https://www.leg.state.fl.us/Statutes/index.cfm?App_mode=Display_Statute&URL=0500-0599%2F0509%2FSections%2F0509.241.html). See our Clearwater Beach page for the Tourist District.

## Taxes on Clearwater vacation rentals

A month-long stay is still a rental of six months or less, so it owes Florida’s 6% sales tax under [§212.03](https://www.leg.state.fl.us/Statutes/index.cfm?App_mode=Display_Statute&URL=0200-0299%2F0212%2FSections%2F0212.03.html) and any applicable county discretionary sales surtax. Pinellas County’s tourist development tax under [§125.0104](https://www.leg.state.fl.us/Statutes/index.cfm?App_mode=Display_Statute&URL=0100-0199%2F0125%2FSections%2F0125.0104.html) is 6%, collected by the county according to the [DR-15TDT chart](https://www.floridarevenue.com/Forms_library/current/dr15tdt.pdf) (R. 10/26).

## How Florida Hosts manages Clearwater rentals

In mainland Clearwater we set listings up with the minimum stay the zoning requires and screen monthly guests the way we screen nightly ones.

Our own cleaning and maintenance crews, and 24/7 guest communication, come with every stay. For Tourist District units, Airbnb management is 18–25% of booking revenue, quoted in writing. Mid-term furnished rentals and long-term leases are both available, the latter through licensed broker partners. Ask for a free rental projection and you will have it within one business day.

The rules

## Clearwater vacation rental rules

Clearwater's Community Development Code says a residential use on residentially zoned property (LDR, LMDR, MDR, MHDR, HDR, NC overlay and MHP) does not include rentals of less than 31 days or one calendar month, whichever is less. Section 3-919, from Ordinance 7105-03 (2003), lists state transient licensing, vacation-rental advertising, overlapping short bookings and booking agents as evidence of such a rental. Overnight accommodations are a use of non-residential districts such as the Tourist (T) District.

Common questions

## Clearwater vacation rental management — FAQs

Is Airbnb legal in Clearwater?

Not for stays under 31 days on residentially zoned property. Clearwater's Community Development Code excludes rentals of less than 31 days or one calendar month from residential use in the LDR, LMDR, MDR, MHDR, HDR, NC overlay and MHP districts. Overnight accommodations belong in districts that allow them, such as the Tourist District on Clearwater Beach. Monthly furnished rentals are allowed in residential zones.

What taxes apply to short-term rentals in Clearwater?

Rentals of six months or less, including monthly furnished stays, owe Florida's 6% sales tax (§212.03), any applicable county discretionary sales surtax, and Pinellas County's 6% tourist development tax (DOR form DR-15TDT, R. 10/26), collected by the county.

How does the city decide a home is being rented short-term?

Code §3-919 lists the evidence: state registration or licensing for transient rental under chapters 212 or 509, advertising the home as a vacation rental, overlapping bookings shorter than 31 days, or using an agent to take reservations.

Who books monthly rentals in Clearwater?

The demand drivers are named employers and events: Morton Plant Hospital and spring training at BayCare Ballpark. We price for stays of a month or more.

Do you handle long-term leases in Clearwater?

Yes. Annual leases are arranged through licensed broker partners, with our own staff on maintenance.
