About the region

## Owning a rental in Central Florida & Orlando

Central Florida is the theme-park corridor: Orlando and the counties of Orange, Osceola, Polk, Lake and Seminole, where many vacation homes were built in gated resort communities on purpose. The resort areas around Kissimmee, Davenport, ChampionsGate and Reunion are in Osceola and Polk counties, while the City of Orlando allows only hosted home sharing. Owning a rental here is less about whether guests will come and more about whether a particular address may host them. Osceola County allows short-term rental only in Planned Developments inside a mapped overlay, Polk County approves it subdivision by subdivision, Kissimmee has its own overlay, and the City of Orlando allows hosted home sharing rather than whole-home stays. Tourist taxes differ too, from 4% in Lake County to 6% in Orange and Osceola, and all five counties collect them directly. We start every Central Florida home with that jurisdiction check.

## One region, several rulebooks

In unincorporated Osceola County, the Land Development Code permits short-term rental only in the Planned Development zoning district and only inside the county's Short-Term Rental Overlay. Inside Kissimmee, rentals under 30 days in residential districts need the city's own overlay plus a planned unit development or conditional-use approval, and St. Cloud lists short-term rental only as a conditional use in its two central business districts.

Polk County takes a different route. Its Land Development Code lets a home be used as a short-term rental only when its entire subdivision, Planned Development or phase has been approved, and every short-term rental is registered with the county each year. The City of Davenport, by contrast, lists vacation rentals as permitted with conditions in every residential district.

The City of Orlando allows owner-occupied home sharing, where the owner or tenant lives on site and is present for a single booking at a time. Leasing out an entire home for short-term, transient use is not allowed there except in narrow cases the code lists, such as a hotel or motel use.

## Private covenants can be stricter than the county

Some of the best-known addresses have their own limits. In Celebration, the community charter's rules require every lease to have an initial term of at least one year unless the association board consents in writing, and they make advertising unauthorized short-term rentals a violation in itself.

Other communities were planned for visitors from the start. Reunion Resort, an Osceola County development first approved in 1992, books vacation homes of three to 14 bedrooms inside the resort through its own website. We read the recorded documents for every home, because two nearby addresses can get opposite answers.

## Taxes on Central Florida vacation rentals

Every rental of six months or less owes Florida's 6% sales tax plus a county tourist development tax. The Department of Revenue's DR-15TDT chart lists Orange and Osceola at 6%, Polk and Seminole at 5%, and Lake at 4%, and shows all five as collected by the county rather than the state.

That matters for owners who assume a booking platform handles everything. The Osceola County Tax Collector says the county is not contracted with Airbnb, VRBO or any other platform, so the owner or manager must collect and remit the 6% tourist tax. Polk County's tax is remitted monthly to its Tax Collector and is late after the 20th.

Common questions

## Central Florida & Orlando property management — FAQs

Is Airbnb legal in Orlando?

Only as hosted home sharing inside city limits. City of Orlando Code §58.989 allows owner-occupied home sharing, where the owner or tenant lives on the property and is present during a single booking at a time; leasing an entire dwelling for short-term transient use is not allowed except in the narrow cases the code lists. Hosts must register with the city under §58.990.

Where in Central Florida are whole-home vacation rentals allowed?

In approved places rather than everywhere. Unincorporated Osceola County allows them in Planned Developments inside its Short-Term Rental Overlay, Kissimmee allows them inside its own overlay with a planned unit development or conditional-use approval, Polk County allows them in approved subdivisions and phases, and the City of Davenport lists them as permitted with conditions in its residential districts.

What is the tourist tax in Central Florida counties?

According to the Florida Department of Revenue's DR-15TDT chart (R. 10/26): Orange 6%, Osceola 6%, Polk 5%, Seminole 5% and Lake 4%, all collected by the county. That is on top of Florida's 6% sales tax on rentals of six months or less.

Can I rent my Celebration home on Airbnb?

Usually not. The Celebration Community Charter's Exhibit C Rules require an initial lease term of at least one year unless the association board consents in writing or a supplement allows otherwise, and they bar transient accommodation. We manage annual leases there instead.

Does Florida law stop counties from banning vacation rentals?

Partly. Under §509.032(7)(b), a local law may not prohibit vacation rentals or regulate how long or how often they are rented, unless it was adopted on or before June 1, 2011. Zoning rules adopted before that date, and private HOA or condo covenants, can still limit where short stays happen.
