## Short-term rental and Airbnb management in Madeira Beach

The City of Madeira Beach calls itself “two miles long,” and its rental rules are just as compact. Single-family and low-density neighborhoods are closed to short stays, while the R-3 medium-density district is where vacation rentals and temporary lodging are written in as permitted uses.

That shapes property management in Madeira Beach. A condo or multifamily unit zoned R-3 can operate as a nightly vacation rental. A house in R-1 needs tenants who stay six months or more, and an R-2 duplex or triplex needs stays of at least three months. We check the district before anything else.

## Where guests come from

- **John’s Pass.** The city’s [news page](https://madeirabeachfl.gov/) lists the annual John’s Pass Seafood Festival each October and a resiliency project for the John’s Pass Boardwalk. Pinellas County’s tourism office features [John’s Pass Village & Boardwalk](https://www.visitstpeteclearwater.com/madeira-beach) for dining, shopping and charter fishing.
- **The beach.** The [city](https://madeirabeachfl.gov/) publishes beach access and parking information for its Gulf shoreline.
- **Fishing and boating.** The visitor bureau’s Madeira Beach page centers on [fishing and the pass](https://www.visitstpeteclearwater.com/madeira-beach), and the city code covers the municipal marina and live-aboard rules.
- **Air access.** Guests fly into [St. Pete-Clearwater International Airport](https://www.fly2pie.com/) or Tampa International.

## Madeira Beach short-term rental rules

The zoning chapter defines the limits district by district:

- **R-1 single-family.** [Section 110-176](https://library.municode.com/fl/madeira_beach/codes/code_of_ordinances?nodeId=PTIICOOR_CH110ZO_ARTVDI_DIV2SIMIRE_S110-176DEPUIN) lists short-term rentals as a prohibited use and defines them as rentals of a dwelling, or part of one, for less than six months.
- **R-2 low-density multifamily.** [Section 110-201](https://library.municode.com/fl/madeira_beach/codes/code_of_ordinances?nodeId=PTIICOOR_CH110ZO_ARTVDI_DIV3LODEMURE_S110-201DEPUIN) prohibits rentals of less than three months.
- **R-3 medium-density multifamily.** [Section 110-227](https://library.municode.com/fl/madeira_beach/codes/code_of_ordinances?nodeId=PTIICOOR_CH110ZO_ARTVDI_DIV4MEDEMURE_S110-227PEUS) lists vacation rental and temporary lodging as permitted uses.

The R-1 and R-2 limits trace to Ordinance 1069 of February 28, 2006, before the June 1, 2011 date in [§509.032(7)(b)](https://www.leg.state.fl.us/Statutes/index.cfm?App_mode=Display_Statute&URL=0500-0599%2F0509%2FSections%2F0509.032.html). [Chapter 34](https://library.municode.com/fl/madeira_beach/codes/code_of_ordinances?nodeId=PTIICOOR_CH34EN_ARTVIICHNUPRCO_DIV3SHTEVARE_S34-503RERE) then makes it unlawful to run a residential vacation rental without registering it and holding a certificate of compliance. Its eligibility tests look back to a DBPR license, business tax receipt and tax registration held before February 28, 2006, so in practice it covers rentals that predate the ban.

Every transient rental also needs a DBPR license under [§509.241](https://www.leg.state.fl.us/Statutes/index.cfm?App_mode=Display_Statute&URL=0500-0599%2F0509%2FSections%2F0509.241.html).

## Taxes on Madeira Beach vacation rentals

Rentals of six months or less owe Florida’s 6% sales tax under [§212.03](https://www.leg.state.fl.us/Statutes/index.cfm?App_mode=Display_Statute&URL=0200-0299%2F0212%2FSections%2F0212.03.html) and any applicable county discretionary sales surtax. Pinellas County collects its own 6% tourist development tax, per the Department of Revenue’s [DR-15TDT](https://www.floridarevenue.com/Forms_library/current/dr15tdt.pdf) (R. 10/26).

## How Florida Hosts manages Madeira Beach rentals

In Madeira Beach our short-term rental management and Airbnb management cover R-3 units with nightly and weekly guests, for 18–25% of booking revenue, quoted in writing. We also take on the licensing side: the DBPR license, the Pinellas County tourist tax account and the city paperwork for the unit. Our own cleaning and maintenance staff handle turnovers, and guests reach us 24/7 with questions about parking, beach access or check-in.

Our own cleaning and maintenance staff and 24/7 guest communication support every stay. For R-1 and R-2 homes we manage seasonal stays of the required length, and annual leases go through licensed broker partners. A free rental projection takes one business day.

The rules

## Madeira Beach vacation rental rules

Madeira Beach prohibits short-term rentals in the R-1 single-family district (rentals of less than six months) and the R-2 low-density multifamily district (less than three months), under Ordinance 1069 of February 28, 2006. The R-3 medium-density multifamily district lists vacation rental and temporary lodging as permitted uses. Chapter 34 requires residential vacation rentals to be registered with a certificate of compliance, annual inspection and a responsible party within 25 miles who responds within two hours.

Common questions

## Madeira Beach vacation rental management — FAQs

Is Airbnb legal in Madeira Beach?

In the right district. The city's zoning code prohibits short-term rentals, meaning rentals of less than six months, in the R-1 single-family district, and rentals of less than three months in the R-2 low-density multifamily district. The R-3 medium-density multifamily district lists vacation rental and temporary lodging as permitted uses.

What taxes apply to short-term rentals in Madeira Beach?

Florida's 6% sales tax (§212.03), any applicable county discretionary sales surtax, and Pinellas County's 6% tourist development tax (DOR form DR-15TDT, R. 10/26), collected by the county.

What about older vacation rentals in R-1 and R-2?

Chapter 34 of the city code lets a residential vacation rental keep operating only with a city certificate of compliance, and the requirements tie back to a state DBPR license, city business tax receipt and tax registration held since before February 28, 2006. The certificate is renewed yearly, inspected annually and does not transfer on sale.

What does the city require of a vacation rental's responsible party?

A natural person living within 25 miles who can be reached 24 hours a day, responds to emergency calls within two hours, keeps a guest register open to city inspection, and informs guests of the noise, parking and trash rules.

Can you manage a seasonal rental in R-1 or R-2?

Yes. Leases of six months or more in R-1, or three months or more in R-2, are allowed, and we manage them as mid-term or long-term rentals with licensed broker partners on annual leases.
