You can rent out a Florida homestead for a short time, but there is a hard limit. Under §196.061, renting all or substantially all of the home counts as abandoning it as a homestead, and the exemption for a given year is lost once the home is rented for more than 30 days per calendar year for two consecutive years. A full-time vacation rental does not keep a homestead exemption.

## What does the homestead exemption give you?

Under [§196.031(1)(a)](https://www.leg.state.fl.us/Statutes/index.cfm?App_mode=Display_Statute&URL=0100-0199%2F0196%2FSections%2F0196.031.html), a person who holds title on January 1 and in good faith makes the property a permanent residence is exempt from taxation on up to $25,000 of assessed value. Section 196.031(1)(b) adds a second exemption of up to $25,000 on assessed value above $50,000, for all levies other than school district levies, adjusted each year for inflation.

The larger benefit is often the assessment cap. Under [§193.155(1)](https://www.leg.state.fl.us/Statutes/index.cfm?App_mode=Display_Statute&URL=0100-0199%2F0193%2FSections%2F0193.155.html), the assessed value of a homestead can rise each year by no more than the lower of 3% or the change in the Consumer Price Index. This is the cap known as Save Our Homes, and it resets to just value on January 1 after a change of ownership under §193.155(3)(a).

## What does §196.061 say about renting?

[Section 196.061(1)](https://www.leg.state.fl.us/Statutes/index.cfm?App_mode=Display_Statute&URL=0100-0199%2F0196%2FSections%2F0196.061.html) has two sentences that matter:

1. Renting all or substantially all of a dwelling previously claimed as a homestead is an abandonment of the homestead, and the abandonment lasts until the owner physically occupies the home again.
2. An abandonment after January 1 does not affect the exemption for that year “unless the property is rented for more than 30 days per calendar year for 2 consecutive years.”

The [Florida Department of Revenue’s FAQ](https://floridarevenue.com/faq/Pages/FAQDetails.aspx?FAQID=1635) puts it the same way: you can rent your home after January 1 of any year and keep the homestead for that year, as long as it is not rented for more than 30 days per calendar year for two consecutive years. The section was amended in 2026 by chapter 2026-239, and a note on the statute says the amendments apply retroactively to January 1, 2026, starting with the 2026 tax roll.

The statute does not apply to members of the U.S. Armed Forces whose service is the result of a mandatory obligation or who volunteer, or to certain full-time federal diplomatic, intelligence, consular or foreign service officers required to be stationed outside Florida, under §196.061(2).

## What does that mean for a vacation rental?

Count the days. A homestead rented 30 days or less in each calendar year stays within the statute. A homestead rented more than 30 days in one year, and then more than 30 days again the next year, is past the limit.

Another line applies to long stays. The definition of homestead real estate in [§196.012(13)](https://www.leg.state.fl.us/Statutes/index.cfm?App_mode=Display_Statute&URL=0100-0199%2F0196%2FSections%2F0196.012.html) excludes any portion used for commercial purposes and says that “property rented for more than 6 months is presumed to be used for commercial purposes.” The [Collier County Property Appraiser](https://www.collierappraiser.com/Main_Homestead/LossofHomesteadRentalFraud.html) cites both the 30-day rule and this six-month presumption on its loss-of-homestead page.

Short stays in a homestead are still taxable rentals. Rent for six months or less carries the [6% state sales tax](/resources/florida-sales-tax-on-vacation-rentals/), the county surtax and any [county tourist development tax](/resources/florida-tourist-development-tax-guide/), whether or not the home has a homestead exemption.

## What do property appraisers look at?

Permanent residency is a factual decision made first by the property appraiser under [§196.015](https://www.leg.state.fl.us/Statutes/index.cfm?App_mode=Display_Statute&URL=0100-0199%2F0196%2FSections%2F0196.015.html). The statute lists factors such as a recorded declaration of domicile, where children attend school, place of employment, voter registration at the property address, a Florida driver license, the address on federal tax returns, bank account locations and proof of paying utilities at the property.

The Department of Revenue’s rule on abandonment, [Rule 12D-7.013](https://www.flrules.org/gateway/ruleNo.asp?id=12D-7.013), says a temporary absence for health, pleasure or business does not by itself end homestead status if the owner always has an abiding intention to return, judged from all the facts. The same rule says a home used both as a residence and for business should be split, with the residence portion exempt and the rest taxed.

## What are the penalties?

They are steep. Under [§196.161(1)(b)](https://www.leg.state.fl.us/Statutes/index.cfm?App_mode=Display_Statute&URL=0100-0199%2F0196%2FSections%2F0196.161.html), when a property appraiser finds that someone who was not entitled to the exemption received it in any of the prior 10 years, the appraiser serves a notice of intent to record a tax lien. The property owes the exempted taxes plus a 50% penalty for each year and 15% interest per year, and the owner gets 30 days to pay before the lien is filed.

Section 193.155(10) applies the same 10-year look-back, 50% penalty and 15% interest to a Save Our Homes assessment limit that should not have been granted. Collier County’s page notes that the back taxes can reach as far as ten years.

## What if I turn my homestead into a full-time rental?

Once the homestead is abandoned, the home is taxed as nonhomestead property. For residential property with nine or fewer units, [§193.1554](https://www.leg.state.fl.us/Statutes/index.cfm?App_mode=Display_Statute&URL=0100-0199%2F0193%2FSections%2F0193.1554.html) limits annual assessment increases to 10% for all levies other than school district levies, a looser cap than Save Our Homes.

In counties that waive the annual homestead application, [§196.011(10)(a)](https://www.leg.state.fl.us/Statutes/index.cfm?App_mode=Display_Statute&URL=0100-0199%2F0196%2FSections%2F0196.011.html) requires the owner to notify the property appraiser promptly whenever the use of the property changes in a way that changes its exempt status. Converting a homestead to a full-time rental is that kind of change, and the rental’s tax accounts need to be open before the first booking. Our guides to [state sales tax](/resources/florida-sales-tax-on-vacation-rentals/) and [what Airbnb and Vrbo collect](/resources/airbnb-vrbo-tax-collection-florida/) cover the rental side.

Common Questions

## Frequently Asked Questions

How many days can I rent my Florida homestead and keep the exemption?

Under §196.061(1), renting after January 1 does not affect that year's exemption unless the property is rented for more than 30 days per calendar year for two consecutive years. The Florida Department of Revenue's FAQ states the same rule.

Can I put my homestead on Airbnb for a few weekends a year?

The statute counts rental days, not the platform. Rentals totaling 30 days or less in a calendar year stay inside the §196.061 limit. Short stays are still taxable rentals, so state sales tax and any county tourist tax apply to them.

What is the penalty for keeping a homestead exemption I was not entitled to?

Section 196.161(1)(b) lets the property appraiser go back up to 10 years and collect the unpaid taxes plus a 50% penalty for each year and 15% interest per year, secured by a tax lien. Section 193.155(10) sets the same penalty for an improperly kept Save Our Homes assessment limit.

What happens to Save Our Homes if I lose the homestead exemption?

The Save Our Homes cap in §193.155(1) applies only to homestead property. Nonhomestead residential property with nine or fewer units falls under §193.1554 instead, which limits yearly increases to 10% for non-school levies.

Does renting part of my home count?

Section 196.061 is triggered by renting all or substantially all of the dwelling. The homestead definition in §196.012(13) also excludes any portion used for commercial purposes, so ask your county property appraiser how it treats a rented room or unit.
