By the Florida Hosts team · October 13, 2026 · Rules & Licensing

Florida’s short-term rental rules are set at three levels: the state licenses and taxes every vacation rental, and cities and counties add registration, inspections, occupancy limits and, in older ordinances, zoning bans or minimum stays. This guide gives one line per market we serve, region by region, built from the rules on our own city pages and each linked to the city or county’s primary source. Where we have not verified a city ordinance, we say so and state rules apply.

## What applies everywhere in Florida?

Every vacation rental needs a DBPR license if it is rented more than three times a year for stays under 30 days, or advertised that way. See our [vacation rental license guide](/resources/florida-vacation-rental-license/). Each stay is also subject to Florida’s transient rental tax under [§212.03(1)(a)](https://www.leg.state.fl.us/Statutes/index.cfm?App_mode=Display_Statute&URL=0200-0299%2F0212%2FSections%2F0212.03.html) and the county tourist development tax, with county rates published on the Department of Revenue’s [Form DR-15TDT](https://floridarevenue.com/Forms_library/current/dr15tdt.pdf).

Local governments cannot adopt new bans on vacation rentals or new limits on how long or how often a home is rented, under [§509.032(7)(b)](https://www.leg.state.fl.us/Statutes/index.cfm?App_mode=Display_Statute&URL=0500-0599%2F0509%2FSections%2F0509.032.html). Rules adopted on or before June 1, 2011 are exempt, which explains many of the zoning limits below. Our [preemption guide](/resources/florida-vacation-rental-law-2011-preemption/) explains how that works.

Condo declarations and HOA covenants apply on top of everything here. See our guides to [condo rental restrictions](/resources/florida-condo-rental-restrictions/) and [HOA rental restrictions](/resources/florida-hoa-rental-restrictions/).

## How to read the tables

Each row links to our city page, which has the fuller summary and every source. “No city ordinance verified — state rules apply” means we have not sourced a city rule for that market, not that the city has confirmed it has none. Several markets are unincorporated, so the county code applies; we note the county where that is the case.

## What should you check for your address?

1. Confirm whether the property is inside city limits or in unincorporated county, since that decides whose code applies.
2. Open the source for your market above and check the zoning district for the parcel.
3. Register with the city or county where required, and get the county and city business tax receipts. Our [local business tax guide](/resources/florida-local-business-tax-receipt/) explains those.
4. Read the condo or HOA documents.
5. Meet the safety rules in our [vacation rental safety guide](/resources/florida-vacation-rental-safety-requirements/).

You can also browse every market on [areas we serve](/areas-we-serve/).

## How Florida Hosts helps

We check the local rule for each address before taking on a home, and we provide licensing and registration help: the DBPR license, local registration and tax accounts. Our own cleaning and maintenance staff across Florida run turnovers, and guests get 24/7 communication. Short-term management is 18–25% of booking revenue, quoted in writing. Where a city limits short stays, we manage mid-term and long-term rentals with licensed brokers for the leasing. Request a free [rental projection](/rental-projection/) within one business day.

This guide is general information, not legal advice; local rules change, so confirm the current rule with the city or county before you list a property.

Common Questions

## Frequently Asked Questions

Which Florida cities restrict short-term rentals the most?

On our sourced pages, several cities bar short stays in residential zones, including Miami Beach in single-family homes, Ormond Beach in every residential district, Coral Gables for stays under six months, and Madeira Beach in R-1 and R-2. Others, such as Naples, Palm Beach and St. Petersburg, allow only a few short stays a year.

What applies if my city has no short-term rental ordinance?

State rules still apply: a DBPR vacation rental license, state sales tax and the county tourist development tax, plus any county business tax receipt. Where we write that no city ordinance was verified, it means we did not find and source one, not that the city confirmed it has none, so check with the city before you list.

Can a Florida city pass a new ban on vacation rentals?

Not under current state law. Section 509.032(7)(b) bars local rules that prohibit vacation rentals or regulate how long or how often they are rented, unless the rule was adopted on or before June 1, 2011. Cities can still require registration, inspections, occupancy limits and similar rules.

Do county rules apply inside a city?

It depends on the rule. Inside city limits the city's own zoning code decides where short stays are allowed, as our Kissimmee and Orlando pages show. County tax requirements can still reach into cities: Palm Beach County's short-term rental receipt, for example, applies in Boca Raton, Jupiter and West Palm Beach.

How current is this list?

Each line summarizes the rules on our city page as checked against the cited source in October 2026. Local codes change, so open the source link for your city before relying on a summary.
