Short-term rental and Airbnb management in Lakeland

Lakeland short-term rental rules

Florida requires a license for each vacation rental from the DBPR Division of Hotels and Restaurants under §509.241, and treats a unit rented more than three times a year for under 30 days as transient lodging (§509.013).

When we searched the City of Lakeland Code of Ordinances and Land Development Code in October 2026, neither had a vacation rental registration section. Under §509.032(7)(b), a local government cannot ban vacation rentals or regulate how long or how often they rent unless the rule was adopted on or before June 1, 2011.

That does not make every address eligible. Condo declarations and HOA covenants are private contracts and often set minimum lease terms. We read them for each home before we list it.

Taxes on Lakeland vacation rentals

Stays of six months or less owe Florida’s 6% sales tax under §212.03 and Polk County’s 1% discretionary sales surtax from DR-15DSS.

Polk County’s 5% tourist development tax, authorized by §125.0104, is listed on the DOR’s DR-15TDT chart (R. 10/26) as county-collected. The Polk County Tax Collector takes monthly payments, due on the first of the next month and late after the 20th.
