Short-term rental and Airbnb management in Davenport

Davenport sits on the Polk County side of the theme-park corridor. Its vacation homes are mostly pool homes and townhomes in gated resort subdivisions, built for families and groups who want bedrooms and a private pool for the price of a hotel room or two.

Property management in Davenport starts with jurisdiction. Some homes are inside the City of Davenport, and many more carry a Davenport address but sit in unincorporated Polk County. Each side has its own rulebook, so our short-term rental management begins by checking which one applies and whether the subdivision has short-term rental approval.

Where guests come from

  • The Orlando-area theme parks. Davenport’s resort subdivisions house families on multi-day park trips who would rather drive a little further for more space.
  • ChampionsGate’s golf. The Omni Orlando Resort at ChampionsGate has two 18-hole courses designed by Greg Norman and is the world headquarters of the David Leadbetter Golf Academy, which brings golf groups to rental homes nearby.
  • Extended-stay tourists. Polk County’s own Ronald Reagan Parkway plan names “Extended Stay Tourist” as one of the three main housing markets in the district that covers Polk’s side of ChampionsGate.
  • LEGOLAND Florida. The LEGOLAND Florida Resort in Winter Haven, with its Peppa Pig Theme Park, gives families a second set of parks in Polk County.

Davenport short-term rental rules

Every vacation rental in Florida needs a license from the DBPR Division of Hotels and Restaurants under §509.241.

Inside city limits, the City of Davenport Unified Land Development Regulations are the rulebook. Table 3.07.00(A) lists Short Term Rentals (Vacation Rentals) as permitted with conditions in every residential district from AG to MH-2. Section 4.03.19 reads, in full, that short term rental units are allowed per State of Florida statutes. The regulations were last updated on March 2, 2026, by Ordinance 1396.

Outside the city, Polk County LDC Section 303 defines a short-term rental as a home made available more than three times a year for under 30 days or one calendar month, whichever is less. A single home cannot be rented that way unless its whole subdivision, Planned Development or phase has been approved, and the code warns that deed restrictions can still prohibit it. Each rental must be registered with the Land Development Division every year.

The same section sets day-to-day rules: the state license posted on the back of the main entrance door, a 24-hour contact number for the management company, two covered trash containers, and no tour buses in the residential streets.

Taxes on Davenport vacation rentals

Stays of six months or less owe Florida’s 6% sales tax under §212.03 and Polk County’s 1% discretionary sales surtax, per DOR form DR-15DSS.

Polk County adds a 5% tourist development tax. The DOR’s DR-15TDT chart (R. 10/26) lists it as county-collected, and the Polk County Tax Collector says owners and their managers remit it monthly. Payment is due on the first of the following month and is late after the 20th, and monthly filings moved to the Phenix Online portal on August 17, 2026.

The rules

Davenport vacation rental rules

Inside Davenport city limits, the Unified Land Development Regulations (updated March 2, 2026 by Ordinance 1396) list Short Term Rentals (Vacation Rentals) as permitted with conditions in every residential district, and Section 4.03.19 states that short-term rental units are allowed per State of Florida statutes. In unincorporated Polk County, Land Development Code Section 303 allows a dwelling to be used as a short-term rental only where the entire subdivision, Planned Development or phase has been approved for it, requires annual registration with the Land Development Division, and sets operating rules such as a posted state license and a 24-hour management contact.

Common questions

Davenport vacation rental management — FAQs

Is Airbnb legal in Davenport?

Yes, with conditions that depend on the side of the city line. The City of Davenport's Unified Land Development Regulations list Short Term Rentals (Vacation Rentals) as permitted with conditions in every residential district, and Section 4.03.19 says they are allowed per state statutes. In unincorporated Polk County, a home can be used as a short-term rental only if its whole subdivision, or its phase, has been approved for that use under Polk LDC Section 303.

What taxes apply to short-term rentals in Davenport?

Stays of six months or less owe Florida's 6% sales tax (§212.03), Polk County's 1% discretionary sales surtax (DOR form DR-15DSS) and Polk County's 5% tourist development tax (DOR form DR-15TDT, R. 10/26). The Polk County Tax Collector collects the tourist tax; payments are due on the first of the month after collection and are late after the 20th.

What does Polk County require from a short-term rental owner?

Polk LDC Section 303 requires each short-term rental to be registered every year with the Land Development Division, with a 24-hour contact number for the management company. The state license must be displayed on the back of the main entrance door, alongside the management company's county tax receipt, and each home needs at least two covered, watertight trash containers.

Can tour buses drop guests at a Davenport vacation home?

Not in the residential areas of a subdivision in unincorporated Polk County. Section 303 bars loading, unloading and parking of tour and charter buses there, and treats any vehicle seating more than 15 adults as a bus.

Do you manage mid-term and long-term rentals in Davenport?

Yes. Furnished stays of 30 days or more and annual leases are available, with licensed broker partners handling lease paperwork.
