Winter Haven short-term rental rules

A Winter Haven vacation rental, like any in Florida, must hold a DBPR Division of Hotels and Restaurants license under §509.241. The state treats a unit rented more than three times a year for under 30 days as transient public lodging (§509.013).

When we searched the City of Winter Haven Code of Ordinances in October 2026, it had no vacation rental registration section. Florida’s §509.032(7)(b) stops a local government from banning vacation rentals or regulating how long or how often they rent unless the rule was adopted on or before June 1, 2011.

Private rules still apply. HOA covenants, condo declarations and deed restrictions can set minimum lease terms, and homes just outside city limits follow Polk County’s Land Development Code instead, which requires a subdivision-wide short-term rental approval and yearly registration under Section 303. We confirm the jurisdiction and the documents before a home goes live.

Taxes on Winter Haven vacation rentals

Stays of six months or less owe Florida’s 6% sales tax under §212.03 and Polk County’s 1% discretionary sales surtax (DR-15DSS).

Polk County’s 5% tourist development tax is a county-collected tax on the DOR’s DR-15TDT chart (R. 10/26). The Polk County Tax Collector says it is remitted monthly by owners or managers, and since August 17, 2026, monthly filings go through the Phenix Online portal.
