Clearwater

Mainland Clearwater has spring training, Morton Plant Hospital and a rebuilt downtown waterfront, but its residential zones require rentals of at least 31 days or one calendar month.

Dunedin

Dunedin keeps rentals under three months out of its residential neighborhoods, so short stays here belong in the tourist, business and downtown districts, and seasonal leases fill the rest.

Indian Rocks Beach allows vacation rentals in its residential districts but requires yearly city registration, inspections, and occupancy caps of 10 guests, or 12 in the CT district.

Short-term rental and Airbnb management in Clearwater Beach

Clearwater Beach is not a separate town. It is part of the City of Clearwater, and every rule on this page comes from the city’s Community Development Code. That matters because the code draws a hard line between two kinds of land: the Tourist (T) District, where overnight accommodations are a planned use, and residentially zoned property, where the minimum rental is 31 days or one calendar month.

A nightly vacation rental has to sit on the Tourist District side of that line. Property management in Clearwater Beach starts with confirming which side of that line a unit sits on, then reading the condo association’s own rental rules, which can be tighter than the city’s.

Where guests come from

  • The beach itself. Pinellas County’s Sand Key Park at 1060 Gulf Boulevard carries a Clearwater address and offers beach, boat ramp and picnic facilities.
  • Clearwater Marine Aquarium. The nonprofit aquarium on Windward Passage focuses on the rescue, rehabilitation and release of marine life.
  • Spring training. BayCare Ballpark in Clearwater is home to Phillies spring training and the Clearwater Threshers; the Phillies have trained in Clearwater since 1947.
  • Concerts downtown. The city’s Coachman Park hosts events at The BayCare Sound, including the Clearwater Jazz Holiday.
  • Air access. St. Pete-Clearwater International Airport promotes the Grouper Airport Express between the airport and Clearwater Beach, booked through PSTA.

Clearwater Beach short-term rental rules

The city’s definitions in §8-102 say a residential use on residentially zoned property does not include rentals of less than 31 days or one calendar month, whichever is less. Residentially zoned property means the LDR, LMDR, MDR, MHDR, HDR, Neighborhood Conservation Overlay and MHP districts.

Section 3-919 lists what the city treats as evidence of a short rental in those zones: state transient licensing under chapters 212 or 509, advertising as a vacation rental, overlapping bookings, or using an agent to take reservations. The section dates from Ordinance 7105-03 (2003), before the June 1, 2011 cutoff in §509.032(7)(b).

The Tourist District is where overnight accommodation units are planned, and on Clearwater Beach its development potential follows Beach by Design, the special area plan adopted by Ordinance 6689-01. A unit there still needs a DBPR license under §509.241 and must follow its condo association’s rules.

Taxes on Clearwater Beach vacation rentals

Stays of six months or less owe Florida’s 6% sales tax (§212.03) plus any applicable county discretionary sales surtax. Pinellas County’s tourist development tax is 6% on the DR-15TDT chart (R. 10/26), and the chart lists Pinellas as collecting it directly rather than through the Department of Revenue.

The rules

Clearwater Beach vacation rental rules

Clearwater Beach falls under the City of Clearwater's Community Development Code. On residentially zoned property (LDR, LMDR, MDR, MHDR, HDR, NC overlay and MHP), a residential use does not include rentals of less than 31 days or one calendar month, and advertising or state transient licensing is treated as evidence of such a rental. Overnight accommodations are planned for the Tourist (T) District, where Clearwater Beach development follows the city's Beach by Design special area plan.

  • In Florida, a home rented to guests more than three times in a calendar year for stays of less than 30 consecutive days — or advertised as regularly available for such stays — is a transient public lodging establishment.
    Fla. Stat. §509.013(4)(a)1 (2026)
  • A condominium or cooperative unit, or a house of up to four units, that is a transient public lodging establishment (and not a timeshare) is a "vacation rental" under Florida law.
    Fla. Stat. §509.242(1)(c) (2026)
  • Each public lodging establishment, vacation rentals included, must hold a license from the Division of Hotels and Restaurants of the Florida Department of Business and Professional Regulation (DBPR).

  • A Florida local law may not prohibit vacation rentals or regulate how long or how often they are rented — unless that local law was adopted on or before June 1, 2011.

Common questions

Clearwater Beach vacation rental management — FAQs

Is Airbnb legal in Clearwater Beach?

It depends on the parcel's zoning. Clearwater Beach is inside the City of Clearwater, whose Community Development Code says a residential use on residentially zoned property does not include rentals of less than 31 days or one calendar month. Overnight accommodations are a use of the Tourist (T) District, where Clearwater Beach development follows the Beach by Design plan. We check the zoning of every unit before listing it.

What taxes apply to short-term rentals in Clearwater Beach?

Florida's 6% sales tax (§212.03), any applicable county discretionary sales surtax, and Pinellas County's 6% tourist development tax (DOR form DR-15TDT, R. 10/26), which the county collects.

Is Clearwater Beach its own city?

No. Clearwater Beach is a neighborhood of the City of Clearwater, so the city's Community Development Code, business tax and code enforcement apply. Pinellas County parks such as Sand Key Park carry Clearwater addresses.

Which residential zones does the 31-day rule cover?

The code lists LDR, LMDR, MDR, MHDR, HDR, the Neighborhood Conservation Overlay and MHP as residentially zoned property. Rentals there must run at least 31 days or one calendar month, whichever is less.

Can you manage a monthly rental on a residential street near the beach?

Yes. Furnished stays of a month or longer fit the residential zones, and we manage them alongside nightly rentals in the Tourist District. Long-term leases are handled with licensed broker partners.
