Short-term rental and Airbnb management in Treasure Island

Treasure Island handles short stays through its zoning code rather than a separate registration ordinance. The key term is “tourist dwelling”: a house, duplex or condo that is offered mainly by the day, week, month or season. Where the zoning allows tourist dwellings, nightly and weekly guests are a permitted use. Where it does not, a home is limited to residential renting.

So the first step in property management in Treasure Island is pulling the parcel’s district. A unit in the resort districts can work as a full-time vacation rental. A house in the RU-75 single-family district is better suited to seasonal or annual tenants.

Where guests come from

Treasure Island short-term rental rules

The definitions in §68-2 set out how the city tells a tourist dwelling from a residential one. A home used mainly on a daily, weekly, monthly or seasonal basis is a tourist dwelling. If the home is the occupant’s legal domicile, or its occupancy changes fewer than six times in a continuous 12 months, the city presumes it is not. In the RU-75 district, more than two turnovers a year flips the presumption the other way.

The permitted-use lists then decide where tourist dwellings may operate:

  • Allowed: the RFM-30 resort medium district (§68-282), the RFH-50 resort high district, and the CG commercial district, which applies the resort-district standards.
  • Not listed: the RU-75 single-family district (§68-242) and the RM-15 multifamily district list residential dwellings but not tourist dwellings.

The city’s business tax receipt article covers rental units, including tourist dwellings. The state side is a DBPR license under §509.241.

Taxes on Treasure Island vacation rentals

Guests staying six months or less pay Florida’s 6% sales tax (§212.03) and any applicable county discretionary sales surtax. The Pinellas County tourist development tax is 6%, and the DR-15TDT chart (R. 10/26) shows it is filed with the county rather than the state.

The rules

Treasure Island vacation rental rules

Treasure Island's zoning code lists 'dwelling, tourist' as a permitted use in the RFM-30 and RFH-50 resort districts and, as regulated by those districts, in the CG commercial district; the RU-75 and RM-15 permitted-use lists do not include it. A dwelling offered mainly on a daily, weekly, monthly or seasonal basis is a tourist dwelling, with a rebuttable presumption against that status if occupancy changes fewer than six times in 12 months. In RU-75, more than two turnovers in a year creates a presumption that a single-family home is a tourist dwelling.

Common questions

Treasure Island vacation rental management — FAQs

Is Airbnb legal in Treasure Island?

In the right zoning district. Treasure Island's code lists 'dwelling, tourist' as a permitted use in the RFM-30 and RFH-50 resort districts and in the CG commercial district, but not in the RU-75 single-family or RM-15 multifamily districts. A home is a tourist dwelling when it is offered mainly on a daily, weekly, monthly or seasonal basis.

What taxes apply to short-term rentals in Treasure Island?

Florida's 6% sales tax (§212.03), any applicable county discretionary sales surtax, and Pinellas County's 6% tourist development tax (DOR form DR-15TDT, R. 10/26), which the county collects.

How does Treasure Island decide whether a home is a tourist dwelling?

The code creates presumptions. A home that is the occupant's legal domicile, or whose occupancy turns over fewer than six times in a continuous 12 months, is presumed not to be a tourist dwelling. In the RU-75 district, a single-family home that turns over more than twice a year is presumed to be one.

Do I need a city business tax receipt?

Treasure Island's business tax receipt article defines a rental unit to include a home, duplex or tourist dwelling used for guest accommodations, and the city's fee schedule lists rental units. We set that up alongside the state license.

Can a single-family home in RU-75 be rented at all?

Yes, as a residential rental with infrequent turnover, such as a seasonal or annual lease. We manage those as mid-term or long-term rentals, with licensed broker partners handling annual leasing.
