Short-term rental and Airbnb management in Miami Beach

Miami Beach draws visitors from all over the world, and it is also strict with owners. The city prohibits short-term rentals in every single-family home it contains, so the houses on the Sunset Islands and La Gorce Island are not candidates for nightly stays at all. What remains is a defined set of apartment and condo buildings in zones the city has approved, from South Beach to North Beach. The city’s published list includes addresses on Alton Road, Washington Avenue and 71st Street.

So property management in Miami Beach begins with one question: is this unit on the approved list? If it is, Airbnb management works much as it does elsewhere, with the added steps of a city license and a city tax account. If it is not, we say so plainly and talk about leasing it for longer than six months instead.

Where guests come from

The beach itself is the main draw, from South Pointe Park up through Mid-Beach and North Beach. The Art Deco buildings along Ocean Drive and Collins Avenue, the pedestrian mall on Lincoln Road and the Miami Beach Botanical Garden pull visitors who want to walk everywhere.

Events matter too. The Miami Beach Convention Center hosts Art Basel Miami Beach every December along with trade shows through the year, and New World Symphony performs at the New World Center on 17th Street. Mount Sinai Medical Center on Alton Road brings patients’ families and visiting clinicians. Guests usually fly into Miami International Airport across Biscayne Bay.

Miami Beach short-term rental rules

The city’s vacation and short-term rental page defines a short-term rental as a stay of less than six months and one day. Under Resiliency Code 7.5.4.13(d)(E) and 7.5.4.11(a), those rentals are prohibited in all single-family homes and in many multi-family buildings in certain zoning districts. A property listed on the city’s Short-Term Rental Zoning Map in a qualified zone may operate once it holds a Vacation/Short-Term Rental Business Tax Receipt.

City Code §102-386 adds the owner’s duties before any listing goes live: a sworn affidavit, the Business Tax Receipt, a resort tax registration certificate, written authorization from the condo association, liability insurance, registration with the Florida Department of Revenue, and both city numbers shown on every listing. Occupancy is capped at two persons per bedroom, outdoor amplified sound is banned at all times, and a guest register must be kept. Breaking §102-386 carries a $1,000 fine the first time; a second violation within six months is $5,000 plus revocation of the Business Tax Receipt or certificate of use.

The city’s Practice Safe Renting lookup shows whether a specific unit is authorized, and the state’s DBPR vacation rental license applies as well.

Taxes on Miami Beach vacation rentals

Stays of six months or less carry Florida’s 6% sales tax under §212.03 and Miami-Dade’s 1% discretionary sales surtax from the state’s DR-15DSS for 2026.

The state’s DR-15TDT chart lists the local rate for Miami Beach at 7%, compared with 6% for most of the county. Miami-Dade’s tourist tax page explains why: Miami Beach pays the county’s 3% convention development tax but not its other room taxes, and the city adds its own 4% resort tax on room rent. The resort tax is filed with the city by the 20th of each month, and bookings made through Airbnb and similar sites must be reported in those filings.

How Florida Hosts manages Miami Beach rentals

In Miami Beach our first job is confirming a unit is authorized. After that, our Airbnb management handles the listing with the required city numbers, pricing, 24/7 guest communication, the guest register, and cleaning and maintenance by our own staff.

Our short-term rental management fee is 18–25% of booking revenue, quoted in writing. For units outside the approved buildings, we manage leases longer than six months with licensed brokers handling the leasing. A free rental projection comes back within one business day.

The rules

Miami Beach vacation rental rules

Miami Beach prohibits vacation and short-term rentals (less than six months and one day) in all single-family homes and in many multi-family buildings in certain zoning districts, under Resiliency Code 7.5.4.13(d)(E) and 7.5.4.11(a). Properties in a qualified zone on the city's Short-Term Rental Zoning Map may operate with a Vacation/Short-Term Rental Business Tax Receipt and a resort tax account, and City Code §102-386 requires both numbers in every advertisement or listing. Condo units also need written authorization from the association, and the maximum occupancy is two persons per bedroom.

  • In Florida, a home rented to guests more than three times in a calendar year for stays of less than 30 consecutive days — or advertised as regularly available for such stays — is a transient public lodging establishment.

  • A condominium or cooperative unit, or a house of up to four units, that is a transient public lodging establishment (and not a timeshare) is a "vacation rental" under Florida law.

Common questions

Miami Beach vacation rental management — FAQs

Is Airbnb legal in Miami Beach?

Only in qualified locations. The City of Miami Beach says vacation and short-term rentals (under six months and one day) are prohibited in all single-family homes and in many multi-family buildings in certain zoning districts. A property in a qualified zone on the city's Short-Term Rental Zoning Map can operate with a Vacation/Short-Term Rental Business Tax Receipt and a resort tax account.

What taxes apply to short-term rentals in Miami Beach?

Florida's 6% sales tax (§212.03) and Miami-Dade's 1% discretionary sales surtax (DR-15DSS, 2026), plus a 7% local rate listed for Miami Beach on DOR form DR-15TDT. Miami-Dade's tourist tax page explains that rate as the county's 3% convention development tax plus the City of Miami Beach's 4% resort tax on room rent, which is filed with the city.

How do I check if a Miami Beach unit is approved for short-term rental?

The city runs a Practice Safe Renting lookup that shows whether a unit is authorized, and publishes a list and map of apartment buildings authorized for short-term rental. We check both before taking on a property.

Can I rent my Miami Beach condo for 30 days or more instead?

Miami Beach defines a short-term rental as less than six months and one day, so a one-, two- or three-month furnished stay is still a short-term rental under city rules. In a building that does not qualify, the compliant option is a lease longer than six months, which we manage with licensed brokers.

What are the fines for an illegal short-term rental in Miami Beach?

City Code §102-386 sets a $1,000 civil fine for a first violation of its listing and registration requirements, and $5,000 plus revocation of the Business Tax Receipt or certificate of use for a second violation within six months.
