About the region

Owning a rental in South Florida

South Florida runs from Homestead to Jupiter across three counties, Miami-Dade, Broward and Palm Beach, and owning a rental here means dealing with a different rulebook in almost every city. Miami Beach bans short-term rentals in all single-family homes. Fort Lauderdale lets them operate with a city certificate, a yearly inspection and a noise monitor. Dania Beach sets a five-day minimum, Pompano Beach permits any stay of six months or less, and the Town of Palm Beach treats a residence as a home for at least three months. Taxes differ too: each county levies its own tourist tax and its own sales surtax on top of Florida’s 6%. Florida Hosts checks the city code, the county tax setup and the condo or HOA documents for each address first, then runs Airbnb management, furnished mid-term stays or annual leases, whichever the property legally supports.

One region, three tax setups

Every stay of six months or less in South Florida carries Florida’s 6% sales tax under §212.03, plus a county tourist tax under §125.0104 and a county discretionary sales surtax. DOR form DR-15TDT lists a 6% local transient rental tax in each of Miami-Dade, Broward and Palm Beach counties, with Miami-Dade’s rate shown as 7% in Miami Beach and 4% in Surfside and Bal Harbour. All three counties collect their tourist taxes themselves rather than through the state.

The surtaxes differ. DOR form DR-15DSS for 2026 lists 1% in Miami-Dade, 1% in Broward and 0.5% in Palm Beach, where a new school surtax replaced the county’s 1% infrastructure surtax at the start of 2026. In Palm Beach County, the Tax Collector says online platforms do not remit the tourist development tax, so hosts must file it themselves every month.

City rules decide what a property can be

Florida law requires a DBPR license for any unit rented more than three times a year for less than 30 days, and it bars cities from banning vacation rentals or regulating their duration unless the rule was adopted on or before June 1, 2011. Within those limits, South Florida cities regulate heavily through registration, inspections, occupancy caps and response-time rules. Fort Lauderdale caps overnight guests at two per sleeping room and requires a responsible party who can reach the house within an hour; Hollywood expects most complaints resolved within 30 minutes.

Some places restrict short stays outright. Miami Beach prohibits short-term rentals of less than six months and one day in all single-family homes and many multi-family buildings. Delray Beach presumes a prohibited transient use when a home in single-family zoning turns over more than six times a year. The Town of Palm Beach classifies occupancy of less than three months, more than three times a year, as a commercial use. For homes like these, we manage seasonal, mid-term or annual rentals instead.

Where the guests come from

Three international airports, Miami, Fort Lauderdale-Hollywood and Palm Beach, and two cruise ports, PortMiami and Port Everglades, keep guests arriving year round, and Brightline links Miami, Aventura, Fort Lauderdale, Boca Raton and West Palm Beach by rail. Events such as Art Basel Miami Beach and the Fort Lauderdale International Boat Show, and spring training for the Cardinals and Marlins in Jupiter, add peaks to the calendar.

Hospitals and universities bring longer stays, from Memorial Regional Hospital and Joe DiMaggio Children’s Hospital in Hollywood to Florida Atlantic University’s main campus in Boca Raton. Those guests often want a furnished home for 30 days or more, which is outside Florida’s vacation rental definition but still taxed as a transient rental when six months or less.

Common questions

South Florida property management — FAQs

Is Airbnb legal in South Florida?

It depends on the city and the building. Florida requires a DBPR license for vacation rentals, and most South Florida cities add their own registration or license: Fort Lauderdale, Hollywood, Hallandale Beach, Pompano Beach, Deerfield Beach, Dania Beach and Lauderdale-by-the-Sea all run local programs. Miami Beach bans short-term rentals in single-family homes, Delray Beach limits turnovers in single-family zoning, and the Town of Palm Beach sets a three-month standard for residential occupancy. Condo and HOA rules can restrict rentals further.

What taxes do South Florida vacation rentals pay?

Florida’s 6% sales tax plus a county surtax (1% in Miami-Dade and Broward, 0.5% in Palm Beach for 2026) and a county tourist tax of 6%, which DR-15TDT shows as 7% in Miami Beach and 4% in Surfside and Bal Harbour. Each county collects its own tourist tax.

Which South Florida cities set a minimum stay?

Dania Beach prohibits vacation rentals of fewer than five consecutive days in homes and buildings of up to four units, and Lauderdale-by-the-Sea requires at least seven days in single-family homes and townhouses. Miami Beach defines a short-term rental as less than six months and one day and bans it in single-family homes, and the Town of Palm Beach allows stays under three months no more than three times a year.

Does Airbnb collect tourist tax for South Florida hosts?

Not everywhere. The Palm Beach County Tax Collector states that online platforms do not remit its tourist development tax, so Palm Beach County hosts must collect and file it monthly. In Broward, Fort Lauderdale and Hollywood accept a statement where the platform collects the county tax, so the answer depends on the county and how each listing is set up.
